1. Acceptance of Terms
These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("Client" or "User") and Turistard ("Company"), a travel agency duly organized and operating under the laws of the Dominican Republic.
By registering an account, accessing our website at https://turistard.com, or purchasing any travel service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our services.

4. Booking & Reservation Process
4.1 Booking Requests: Submitting a booking form on our website constitutes a request, not a confirmed reservation. Confirmation is provided only after we verify availability and send written confirmation to your registered email.
4.2 Accuracy of Information: You are responsible for providing accurate and complete information when making a booking request, including travel dates, number of guests, and contact details. Turistard assumes no liability for errors arising from inaccurate client-submitted information.
4.3 Age Requirement: You must be at least 18 years of age to make a booking. By submitting a request, you confirm that you meet this requirement.
4.4 Booking Confirmation: A booking is confirmed only upon receipt of a written confirmation email and the required deposit or full payment as specified at the time of booking.
5. Pricing & Payment
5.1 Currency: All prices are displayed in US Dollars (USD) unless otherwise stated.
5.2 Pricing Accuracy: We strive to maintain accurate pricing. In the event of a pricing error, we will notify you prior to processing your booking and offer the option to proceed at the correct price or cancel without penalty.
5.3 Deposit Requirements: Most bookings require a non-refundable deposit of 20–50% of the total price to secure the reservation. The exact percentage will be stated in your booking confirmation.
5.4 Payment Methods: We accept major credit cards, debit cards, and bank transfers processed via PCI-DSS compliant payment gateways. Payments are due as specified in the booking confirmation.
5.5 Taxes & Fees: Prices may be subject to the Dominican Republic ITBIS tax (18%) and other applicable surcharges. All applicable taxes will be disclosed before payment.
6. Cancellation & Refund Policy
Pursuant to Law No. 288-05 (Consumer Protection) and standard international travel industry practices:
Cancellation requests must be submitted in writing to teamturistard@gmail.com. The cancellation date is the date we receive your written request. Refunds, where applicable, will be processed within 15 business days to the original payment method.
7. Modifications & Changes
7.1 Client-Requested Changes: Changes to confirmed bookings are subject to availability and may incur modification fees. Requests must be submitted in writing at least 72 hours before the service date.
7.2 Company-Initiated Changes: In the event that Turistard or a supplier must modify your booking (e.g., due to force majeure, supplier unavailability, or regulatory requirements), we will notify you as soon as possible and offer an equivalent alternative or a full refund.
7.3 Force Majeure: We are not liable for cancellations or modifications resulting from circumstances beyond our reasonable control, including natural disasters, pandemics, strikes, government travel restrictions, or acts of God.
8. Tourist Rights Under Dominican Republic Law
In accordance with Law No. 288-05 and MITUR regulations, tourists in the Dominican Republic are entitled to:

9. Travel Documents & Insurance
9.1 Travel Documents: You are solely responsible for ensuring that you hold valid travel documents (passport, visa, etc.) required for your destination. Turistard is not responsible for denied entry due to invalid or missing documentation.
9.2 Health Requirements: You are responsible for checking and complying with health and vaccination requirements for your destination, including COVID-19 or other entry requirements in effect at the time of travel.
9.3 Travel Insurance: We strongly recommend that all clients purchase comprehensive travel insurance covering cancellation, medical emergencies, lost baggage, and repatriation. Turistard does not provide travel insurance.
10. Liability & Disclaimers
10.1 Agency Role: Turistard acts as an intermediary between clients and third-party service providers (hotels, airlines, excursion operators, etc.). We are not responsible for the acts, omissions, negligence, or default of such providers.
10.2 Limitation of Liability: To the maximum extent permitted by Dominican Republic law, our total liability to you in respect of any claim shall not exceed the amount paid by you for the specific service giving rise to the claim.
10.3 No Warranty: We make no warranties regarding third-party service quality, punctuality, or accuracy of supplier-provided information. All descriptions are provided in good faith based on information available at time of publication.
10.4 Indemnification: You agree to indemnify and hold harmless Turistard from any claims, damages, or expenses arising from your violation of these Terms or applicable law.
11. Intellectual Property
All content on our website, including images, text, logos, graphics, and software, is the exclusive property of Turistard or its licensors and is protected under Dominican Republic Law No. 65-00 on Copyright and international intellectual property treaties.
You may not reproduce, distribute, modify, or create derivative works from any content on our website without prior written permission. Unauthorized use constitutes infringement and may result in legal action.

Violation of these conduct standards may result in immediate account suspension and cancellation of all active bookings without refund.
13. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Dominican Republic.
Dispute Resolution Process:
1. Informal Resolution: We encourage you to contact us at teamturistard@gmail.com to resolve any dispute informally within 30 days.
2. Pro Consumidor Mediation: If not resolved informally, disputes may be submitted to Pro Consumidor (Dominican Republic Consumer Protection Agency) for mediation.
3. MITUR Complaint: Tourism-related disputes may also be filed with the Ministry of Tourism of the Dominican Republic (MITUR).
4. Judicial Proceedings: If mediation fails, disputes shall be subject to the exclusive jurisdiction of the courts of Santo Domingo, Dominican Republic.
14. Changes to These Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. For material changes, we will provide notice via email or a prominent website notice at least 14 days before the changes take effect.
Your continued use of our services after the effective date of any changes constitutes acceptance of the revised Terms.
